SUCCESSFUL HUMANITARIAN PROTECTION CASE FOR A UKRAINIAN FAMILY FROM KHARKIV

14.08.2025
In the wake of a wave of asylum claim refusals that began shortly after the Home Office published its White Paper in May 2025, our immigration advisor, Tetiana Deren, assisted by a paralegal, Daria Kotkova, has successfully secured humanitarian protection for a Ukrainian family from Kharkiv.
The family’s case was complex, as both the father and child live with serious medical conditions. Their claim was supported by credible, consistent, and detailed evidence demonstrating a real and substantial risk of serious harm if they were returned to Ukraine. We were able to establish that their individual medical and family circumstances, when considered alongside the ongoing war, placed them among the most vulnerable individuals affected by the conflict.
Our team not only gathered and presented substantive medical evidence but also prepared a separate, carefully reasoned submission on why internal relocation was not a viable option for the claimants. In doing so, we challenged the Home Office’s CPIN guidance, which currently designates only a few regions of Ukraine as unsafe, and successfully argued that this interpretation did not reflect the family’s real risk.
This outcome demonstrates that with a carefully drafted legal submission and a thorough examination of personal circumstances, it is still possible to secure a positive decision in even the most challenging climate. At Sterling Law, we treat every claim as unique, tailoring our approach to the individual’s situation rather than relying on a one-size-fits-all strategy.
