UKVI Introduces New UK/European Applicant Transfer Scheme (UEATS) – Key Changes in Immigration Rules (August 2025)

On 5th August 2025, the UK Home Office published the latest Statement of Changes in Immigration Rules, unveiling significant updates that mark a new chapter in the UK’s immigration framework.
Central to these updates is the introduction of the UK/European Applicant Transfer Scheme (UEATS)—a pioneering immigration pathway designed to manage migration flows between the UK and France.
What’s New?
The UEATS creates a formal process allowing individuals currently in France to transfer their immigration applications to the UK under controlled and structured conditions. This scheme is part of a broader cooperation between the UK and France, aiming to reduce dangerous irregular migration routes and improve cross-border management.
Key Features of the UK/European Applicant Transfer Scheme:
- Two-Stage Application Process:
Applicants must first submit an Expression of Interest. If selected, they can then proceed to submit a formal Entry Clearance application.
- Location Restriction:
Applications under this scheme must be submitted exclusively from within France.
- Age Requirement:
Applicants must be 18 years or older unless applying alongside a family member who is over 18.
- Cap System Linked to Removals:
The number of applicants transferred to the UK under the scheme will be limited and directly related to the number of people removed from the UK to France under the new pilot arrangement on the prevention of dangerous journeys.
- Application Windows:
The scheme will operate during specific time periods, allowing applications only within designated submission windows.
- Family Applications:
There are special provisions allowing family groups to apply together under the scheme.
- Limited Permission Granted:
Successful applicants receive a 3-month entry clearance to the UK. This clearance does not permit work, study, or access to public funds during this period.
- Treaty-Dependent Implementation:
The scheme will only come into force once the UK-France treaty on preventing dangerous journeys is officially enacted.
Updates to Part 9 Applications
The immigration rules also update Paragraph 9.1.2 to formally include the UK/European Applicant Transfer Scheme among the applicable pathways under Part 9 applications, reflecting the new process in the broader immigration framework.
Administrative Enhancements
In addition to these major changes, the document introduces a new requirement for the Secretary of State to review relevant immigration rules every five years. Reports on the effectiveness of these rules must be published, ensuring ongoing oversight and accountability.
What Does This Mean?
The introduction of the UEATS marks a significant shift towards more collaborative migration management between the UK and France. It aims to streamline legal pathways for those seeking to transfer their claims while deterring unsafe and irregular migration routes. However, the scheme’s strict eligibility criteria and limited permissions reflect the UK government’s cautious approach.
If you or someone you know might be affected by these changes or wish to explore the implications for your immigration status, it is advisable to seek professional legal advice to understand how this new pathway may apply.
