    Statement of Changes Published – Key Immigration Updates You Should Know

    The Home Office has published a new Statement of Changes to the UK Immigration Rules, introducing important updates across multiple visa categories, settlement pathways, and eligibility criteria.
    Below is a summary of the key provisions that applicants, sponsors, and practitioners should be aware of.

    Highlights of the Changes

    1. Visit Visa Requirement for Botswana Nationals

    Nationals of Botswana are now required to obtain a visit visa before travelling to the UK.

    2. Recognition of Palestine

    The UK has amended its visa national list to recognise Palestine, with implications for visa processing and nationality classification.

    3. German School Groups Travel

    Travel requirements for German school groups visiting the UK have been relaxed, supporting smoother educational visits.

    4. Validity Requirements for Victims of Human Trafficking or Slavery

    Adjustments have been made under Appendix Temporary Permission to Stay, clarifying the validity period for victims of human trafficking or slavery.

    5. Dependants for Stateless Persons

    Under Appendix Statelessness, stateless applicants may now include dependants in their applications for permission to stay.

    English Language Requirements Raised to B2 Level

    The English language requirement has been increased from B1 to B2 Level (CEFR) for the following routes:

    This represents a significant tightening of the language criteria for economic migration routes.

    Implementation date:

    • The new requirement applies to initial applications made on or after 8 January 2026.
    • Applicants who already hold permission under these routes and were previously assessed at B1 level will continue to be assessed at B1 for any future extensions on the same route.

    High Potential Individual (HPI) Route Expansion and Cap

    The High Potential Individual route is being expanded and refined, with two key changes:

    • The list of eligible global institutions will be doubled, subject to exclusions at the discretion of the Secretary of State (for example, on national security or foreign policy grounds).
    • A cap of 8,000 applications per year will be introduced.

    This adjustment follows commitments outlined in the Immigration White Paper (May 2025) and aims to balance talent attraction with system control.

    Graduate Route Duration Reduced to 18 Months

    The Graduate route, which currently allows graduates to stay in the UK for two years (or three years for PhD holders), will be shortened to 18 months for most applicants.

    • This change will apply to applications submitted on or after 1 January 2027.
    • PhD graduates will continue to receive three years of leave.
    • The change follows government data suggesting that many graduates on this route are not progressing into graduate-level roles, which the route was originally designed to facilitate.

    Students Transitioning to the Innovator Founder Route

    Student visa holders who have completed their course will now be permitted to establish a business in the UK by switching directly into the Innovator Founder route.
    This replaces the previous provision allowing switches to the Start-up route, which is now closed to new applicants.

    Suitability Rules Replace Grounds for Refusal

    The previous Part 9: Grounds for Refusal is being replaced by a unified Part Suitability, which will now apply across various visa routes.

    To ensure consistency:

    • The Family and Private Life rules are being amended (Appendices FM, Private Life, Adult Dependant Relative, and Settlement Family Life) to apply these common suitability provisions.
    • This removes the separate “bespoke” suitability standards previously applied under these categories, creating a single framework for assessing refusals and discretionary factors.

    Seasonal Worker Route Changes

    Applicants under the Appendix Temporary Work – Seasonal Worker route will now need to spend a required period outside the UK before reapplying for another seasonal work visa.

    Ukraine Permission Extension Scheme

    Adjustments have been made to the Ukraine Permission Extension Scheme to maintain and reinforce safeguarding measures for affected individuals.

    • Check your route requirements — especially if you are applying after January 2026 (for English language) or January 2027 (for Graduate route changes).
    • Employers and sponsors should review recruitment and sponsorship planning in light of the higher language level.
