Can Your Child Become a British Citizen? A Recent Success Story at Sterling Law

    12.11.2025

    Co-author: Daria Kotkova

British citizenship offers children a secure future and countless opportunities. It grants the right to live, work, and study in the UK without immigration restrictions, access to healthcare under the NHS, visa-free travel to more than 130 countries, and full participation in civic life. For parents raising children in the UK, securing citizenship is an important step toward ensuring stability, safety, and long-term integration.

Automatic Acquisition of Citizenship at Birth

Under the British Nationality Act 1981, some children automatically acquire citizenship at birth – for example, if one of their parents is a British citizen or holds settled status in the UK. Others, however, must apply for registration as a British citizen. This process allows the Secretary of State to exercise discretion and grant citizenship in cases that meet the statutory and compassionate criteria.

Case Study: Registration for a Child Born in the UK

At Sterling Law, we recently represented a family whose child was born in the UK but was not automatically granted British citizenship at birth. The parents had uncertain immigration status at the time, and as a result, the child was not considered British by descent. After reviewing their circumstances, Tetiana Deren and Daria Kotkova identified that the child was eligible for registration under the provision allowing children born in the UK who have lived here continuously for the first ten years of their life to apply for British citizenship.

    Preparing a Comprehensive Application

Our team prepared a comprehensive application package demonstrating the child’s residence history, strong connection to the UK, and the family’s lawful immigration pathway. We also provided evidence addressing the child’s best interests and welfare considerations, ensuring full compliance with the Home Office’s guidance.

    Successful Outcome

Despite the Home Office’s stringent requirements, the application was approved smoothly. The child was successfully registered as a British citizen, marking the completion of a life-changing process for the family.

This case highlights how even seemingly straightforward applications can involve complex legal nuances. Each family’s situation is unique – factors such as parents’ immigration history, residence records, and the child’s birthplace can all impact eligibility.

At Sterling Law, we provide detailed assessments, prepare robust applications, and represent families throughout the entire process – from eligibility reviews and document preparation to communication with the Home Office.

If your child was born in the UK but has not yet obtained British citizenship, or if you are unsure about their eligibility, our legal team can help you take the next step.
