Finding a Way Forward: Securing Status After Divorce from an EU Spouse

Some immigration cases begin straightforwardly but become complex when circumstances change. One of our recent success stories involved a client who had been living in the United Kingdom as the spouse of an EU citizen and completing the qualifying period required under the EU Settlement Scheme.

After several years in the UK, her marriage broke down, and she divorced her EU partner. They had no ongoing contact, and she was unable to obtain any documents or statements from him that would normally be required to support her application.

This left our client in a difficult and uncertain position. She had built her life in the UK, met the residence requirements and wished to secure her future here, but the lack of cooperation from her former spouse meant that the usual pathway was no longer available. Many applicants find themselves in similar situations and are unsure whether they can continue under the Scheme once a relationship has ended.

Addressing the Issue: A Tailored Strategy

The members of our immigration team, Tetiana Deren and Daria Kotkova, reviewed the case in detail and developed a strategy tailored to the client’s unique circumstances. The key was identifying how she could rely on her own residence and rights rather than the partnership route. This required a clear explanation of her history in the UK, evidence of her lawful residence during the qualifying period and a structured approach demonstrating her eligibility.

    Administrative Challenges: Bureaucratic Inconsistencies

Another significant challenge arose from the administrative side. During preparation, the Home Office issued conflicting instructions regarding which forms and processes should be used, creating uncertainty and delay. Our team managed this bureaucratic inconsistency by maintaining clear communication, ensuring the correct legal position was set out and guiding the application through the shifting procedural requirements.

Successful Outcome: Securing Status Without Partnership Dependency

Despite the obstacles, the submission was carefully prepared, well-evidenced and fully aligned with the requirements of the Scheme. The Home Office granted the client the status she needed, allowing her to remain in the United Kingdom and continue her life here without relying on her former partner.

If your circumstances have changed since arriving in the UK or you are unsure whether you still meet the requirements for the EU Settlement Scheme or any other immigration category, our team is here to help. Contact us to discuss your situation and receive clear, practical guidance tailored to your needs.
