    SUCCESSFUL SPOUSE VISA APPLICATION FOR A UKRAINIAN NATIONAL

    Our immigration advisor, Tetiana Deren, has successfully secured a positive decision for a spouse visa application made from within the UK.

    The applicant, a national of Ukraine, applied on the basis of an unmarried partner relationship. Before coming to the UK, she resided in Ukraine but was compelled to leave due to the Russian Federation’s invasion, subsequently entering the UK under the Ukraine Scheme. The couple began their relationship before that, in March 2019, and have been living together in a relationship since October 2022.

    As the couple was unmarried, the application required a detailed demonstration of the genuineness of their relationship. Our team carefully gathered a comprehensive range of supporting evidence, including photographs, correspondence, witness statements, and other documentation. Each piece of evidence was clearly explained in a detailed cover letter, which outlined how the applicant met all the relevant eligibility and suitability requirements under the Immigration Rules.

    We placed particular emphasis on the applicant’s rights under Article 8 of the European Convention on Human Rights. We argued that refusing to grant her leave to remain in the UK would constitute a disproportionate interference with her private and family life, as there were no legitimate aims that could justify such a decision.

    Thanks to this thorough and evidence-driven approach, the application was approved, allowing the applicant to continue her life in the UK with her partner.
