Protecting Child Welfare: A Victory in Child Arrangements Order Proceedings

In this case, Dafina Morina, our Family Law Legal Consultant, represented the Mother in Child Arrangements Order proceedings initiated by the Father, who sought to share lives with their daughter. Our client strongly opposed this, citing concerns over ongoing domestic abuse allegations against the Father. Complicating matters, Father admitted to covertly recording the client and child at home.
The Child’s Wishes and Welfare at the Forefront
Central to our client’s case was the child’s expressed reluctance to have contact with the Father, asserting that it was not in the child’s best interest. Despite claims from the Father that our client was influencing the child against him, the court concluded that no direct contact order should be made. Instead, contact would only occur if the child voluntarily desires it.
Following a highly emotional legal battle that commenced in 2023, the court ultimately ruled in our client’s favour. The final decision allowed our client to maintain regular updates to the Father in writing, acknowledging his parental responsibilities. However, contact remains contingent upon the child’s wishes, ensuring her welfare remains the priority.
