    Spouse Visa Extension Granted Under Appendix FM

    We are delighted to share another successful outcome for our client, who has been granted further leave to remain in the United Kingdom as the spouse of a partner settled here, under Appendix FM of the Immigration Rules.

    Behind every extension application is a family waiting to hear that they can carry on with their life together. This case is a good illustration of what a carefully prepared partner application looks like, and of how much difference thorough preparation makes to the people at the centre of it.

    The Background

    Our client is a Ukrainian national who had previously been granted leave to remain as a spouse. Her partner is settled in the United Kingdom and has held settled status since 2021.

    The couple got married the following year, and they have lived together in the United Kingdom ever since. The UK became their permanent home. Our client is in steady employment and has built strong social and community ties here.

    She came to us as her existing permission approached its expiry and asked us to prepare her extension application.

    Our Approach

    An extension in the partner route is rarely difficult in principle. It can be demanding in practice. The Immigration Rules ask for evidence in a particular form, and an application can fall short on a technicality even where the relationship behind it is beyond doubt. Our main task was to leave the Home Office with no doubt.

    In this matter our team:

    • Clearly evidenced the genuine and subsisting relationship through official documentation and cohabitation records;
    • Confirmed the marital history and the sponsor’s settled status in the United Kingdom;
    • Demonstrated that the financial requirement was met;
    • Provided detailed evidence of adequate accommodation in line with Home Office requirements;
    • Addressed all suitability and English language requirements;
    • Set out the position under Article 8 ECHR in the alternative.

    Every document was organised so that each requirement of the Rules could be traced straight to the evidence that satisfied it. A decision maker should not have to search for the answer to a question the Rules oblige them to ask.

    The Outcome

    The application has been successfully granted. Our client continues to live and work in the United Kingdom alongside her husband, with the security of settled family life and a route that can lead to settlement in due course. For a couple who have built their home and their working lives here, that certainty is worth a great deal.

    Why This Matters

    For many people the United Kingdom is not simply where they happen to live. It is where they have met their partner, made a home and set about building a future. Protecting that is what the partner route exists for, and it is why these applications deserve to be prepared properly rather than filed in hope.

    It is also worth noting that a sponsor does not need to be a British citizen. A partner who is present and settled in the United Kingdom can sponsor a spouse under Appendix FM. This is often misunderstood, and it means the family route is open to a good many couples who assume it is closed to them.
