Successful Settlement for Domestic Violence Victim from Kazakhstan Despite Limited Evidence

17.04.2025
We are pleased to share the successful outcome of a challenging immigration case involving a national of Kazakhstan, who was a victim of domestic violence. Despite facing significant barriers, including very limited supporting evidence, we were able to secure Indefinite Leave to Remain (SET DV) for our client, allowing her to stay safely in the UK.
Background and Challenges
Our client entered the UK on a spouse visa, but unfortunately, she experienced domestic abuse during her relationship. As is often the case in situations involving domestic violence, our client faced immense difficulty in obtaining comprehensive documentation to prove the abuse. This lack of evidence is a common issue for many victims, leaving them feeling helpless and vulnerable within the immigration system.
Our Approach
Given the sensitive nature of the case, we approached the situation with careful and compassionate casework. We understood the challenges our client faced and worked to gather a range of alternative evidence. This included:
- A personal statement from our client detailing her experiences.
- Supporting letters from trusted individuals who could attest to her situation.
- Key documents from third-party professionals, despite the limited availability of concrete evidence.
In addition to gathering evidence, we prepared detailed legal representations that thoroughly explained our client’s circumstances. These representations outlined the barriers she faced in collecting documentation, as well as why her case met the Home Office’s requirements for settlement.
The Outcome
As a result of our diligent efforts, the Home Office granted our client’s application for settlement. They recognized the credibility of her account and the sufficiency of the evidence provided, granting her Indefinite Leave to Remain (SET DV). This was a significant and life-changing decision for our client, allowing her to stay in the UK and rebuild her life.
The Importance of Client-Centered Legal Support
This case underscores the vital importance of trauma-informed, client-centered legal support, especially for vulnerable individuals navigating the immigration system. Domestic violence victims often face multiple challenges, both emotional and procedural, and it is essential to provide them with compassionate and effective legal assistance.
We are incredibly proud to have helped our client achieve safety, stability, and the opportunity to move forward with her life in the UK.
