Successful Indefinite Leave to Remain Application and Visa Extension

18.06.2025
Background
The case involved an applicant who had been living in the UK on a Global Talent visa since receiving a successful endorsement from Tech Nation in 2022. Under the conditions of the Global Talent visa, the applicant was eligible to apply for Indefinite Leave to Remain (ILR) after just 3 years of residence. However, the applicant’s spouse, who was on a dependant visa, needed to complete 5 years of residence before being eligible for ILR. As such, the spouse opted to apply for a visa extension for the time being.
Challenge
The main challenge in this case was ensuring that the applicant met the specific requirements for ILR under the Global Talent route, particularly proving that the applicant had earned income in the UK within the digital technology field. This is a crucial criterion for ILR under the Global Talent visa.
Our Approach
Miss Aliya Rimshelis expertly prepared the applications for both individuals, providing clear advice on which supporting documents were required. This included evidence of income earned in the digital technology sector, in line with the stipulations of the Global Talent visa.
The applications were meticulously prepared, ensuring that all necessary documentation was gathered and presented in the correct format, addressing all requirements set by the Home Office.
Outcome
Thanks to the detailed preparation and expert guidance, the applicant was granted ILR, while the spouse received a visa extension within less than a month. The applicant is now able to live freely in the UK and continue building their career as a Senior Software Engineer. In 2 years, the applicant will be eligible to apply for British Citizenship, and the spouse will also be able to apply for ILR.

This case demonstrates the value of expert legal advice and the importance of careful case preparation. Whether applying for ILR or dealing with visa extensions, our team ensures that all requirements are met to achieve a successful outcome efficiently and effectively.
