Workplace bullying and the Legal Right to Protection: A Case Before the Employment Tribunal

We are currently representing an individual in an employment claim against a limited company following a sustained period of workplace sexual harassment.
Background
Our client, a former employee of the Company, was subjected to repeated acts of mistreatment by their employer, creating a hostile and demeaning work environment in breach of her statutory rights.
Our client sought legal advice from our team prior to raising a formal grievance, allowing us to guide them from the earliest stages of the process. This early intervention ensured that all actions were strategic, fully documented, and compliant with both internal policies and the ACAS Code of Practice.
The matter has now progressed to formal proceedings before the Employment Tribunal. We remain committed to ensuring our client’s voice is heard and their legal rights enforced.
Our Role
Our employment law team has taken a lead role in:
- Advising the client from the outset on her rights under the Equality Act 2010.
- Supporting the client prior to and during the submission of her formal grievance, ensuring that it was well-evidenced and properly escalated.
- Preparing and filing all documentation to the court tribunal, clearly setting out the incidents of sexual harassment and their legal basis.
- Gathering, reviewing and submitting evidence, including internal correspondence and medical documentation.
Legal Grounds
Our client’s claim includes:
- Sexual harassment on the grounds of sex and other protected characteristics.
- Breach of the employer’s statutory and contractual duty to provide a safe working environment.
In addition, we are pursuing compensation for loss of earnings and aggravated damages. We are prepared to challenge the employer’s attempt to avoid liability.
