Client Background:
Our client, a private landlord, had appointed a letting agency to manage a rental property under a formal agreement.
Issue:
The letting agency breached its obligations multiple times, including a serious incident where rental income was transferred to an unauthorized third-party account.
Actions Taken:
- Legal Notice and Position Statement:
Upon discovering the breach, we promptly served notice to redirect all future payments directly to our client. Simultaneously, we prepared a robust legal position statement outlining the agency’s failures and our client’s rights.
- Negotiation and Settlement:
We initiated negotiations with the agency, demanding the immediate refund of the misappropriated rent. Despite initial resistance, a settlement was achieved without resorting to litigation.
Outcome:
- Full Refund: The agency agreed to refund the withheld rent to our client fully.
- Termination of Agreement: The letting agency contract was mutually and permanently terminated on favorable terms to our client.
- Financial Security: Our client regained complete economic control over their rental property operations.
Conclusion:
Through strategic legal action and negotiation, Sterling Law ensured that our client received full compensation and regained control over their rental property affairs, resolving the dispute efficiently and without prolonged litigation.
