    Successful Parent Visa Extension

    Background

    The client first entered the United Kingdom in 2020 on a Start-up visa and switched to a Parent visa in 2022 after the birth of her child, whose father is a British citizen. As her visa neared expiry, the client sought to extend her stay in the UK. However, the case presented challenges due to the reliance on undocumented income from the child’s father and a friend to meet the financial requirements for the visa extension.

    Challenge

    The key difficulty in this case was the lack of formal income documentation, as the client was depending on informal financial support. The Home Office requires applicants to demonstrate that they meet strict financial requirements, and without official income records, proving the legitimacy of the support was difficult.

    Our Approach

    Miss Aliya Rimshelis took a detailed and strategic approach to the case, ensuring all factors were thoroughly addressed. She advised the client to submit various forms of evidence, including:

    • Signed letters of support from both the child’s father and the client’s friend;
    • Bank statements and receipts documenting payments received, serving as evidence in lieu of formal income records;
    • A comprehensive cover letter that emphasised human rights concerns, particularly focusing on the best interests of the child, arguing that refusing the application would be detrimental to the child’s wellbeing.

    This careful preparation not only addressed the financial requirements but also highlighted the personal and emotional elements of the case.

    Outcome

    Due to the thorough preparation and effective presentation of the case, the Home Office approved the Parent visa extension through the Super Priority Service within just 1 day of processing. This allowed the client to remain in the UK, where she can ensure her child grows up with the opportunities and benefits associated with being a British citizen.

    In just 2 and a half years, the client will be eligible to apply for Indefinite Leave to Remain, securing long-term residency in the UK.
